The State brings criminal actions; so you can't sue for malicious prosecution. The statute of limitations on defamation is short; so you need to talk to a lawyer. Unless this person is rich, you'll have trouble finding a lawyer who'll do it on a contingent fee basis. It's probably not cost effective to sue this person.
