The simple answer is "it depends". A waiver may or may not be effective depending on several factors: 1. whether the wrongdoer did the wrong intentionally or negligently, 2. whether the waiver was signed before or after the victim knew about the wrong doing, 3. whether the terms of the waiver are valid, etc.
