Legal Question in Personal Injury in Texas

Single car accident

In July of 2006 I was a passenger in a vehicle that hydroplaned off the road while going the posted speed limit (70mph). The vehicle rolled twice, the car was totaled. The ER in the small town we were near released me 5 hours later saying I had just bumps and bruises. Months later I find out they were wrong (torn rotator cuff, hip problems) the insurance company of the vehicle owner (who was not the driver)is telling me that they will only pay up to 5k in medical and 2500 in personal injury. My bills have already exceeded this. What should I do?

You should contact a lawyer in your area to file a lawsuit against the driver and the owner. You can recover PI damages in excess of the Med Cvg.

This is probably going to come down to what your treating doctor says is the cause of your rotator cuff and hip problems. Does he/she believe that the car wreck caused these conditions?

Also, where did the wreck occur? What is your relationship to the driver?

The answer depends on whether or not your doctors will support your contention that the hip injury and rotator cuff injury were likely the result of the accident. Assuming they do, and the insurance company is being unreasonable, then you can sue to recover damages. I recommend you contact a few lawyers in your local area to see with whom you are the most comfortable.
