Legal Question in Personal Injury in Texas

I was sitting at parking lot when a car turning into the parking lot hit me and my insurance company said i was at fault can i file on his insurance because no police report and i think he was at fault.

yes..u can file and would go to small claims if less than 10k...but if u had full coverage, your insurance must be saying u have to pay deductible or why would they opine?
