My husband was injured on the job 1/3/01 and, he has not been able to find an attorney to file law suite in this case because of it complex nature. He was injured on his 1st day of work and the manager tried to coverup that he was employed with the company and he has been talking with the insurance company of his former employer and he has alos gave them a recorded dtatement on his lifetime injury. my husband is not able to owrk due to this serious injury and in the beginning the Insurance company agreed to pay for all medical bills and any need for my husband and later sent a letter and said they show no negliance on their opart after 1 year. Please respond ASAP. I will need to file suite by Jan. 3,2003. Please help ASAP

For a negligence claim you have two years from the date of inury. For a fraud claim, you have four years. I mention fraud because it may apply to your husband's case.

I had a case where my client was seriously injured on a job site. He was told that the company's worker's compensation benefits did not apply to him because of his employmet status. He questioned the employer repeatedly, and pleaded for coverage, and was refused. After losing everything he hired me and I went ahead and filed a lawsuit. I included negligence and fraud, I voided the applicability of worker's comp., and we were successful.
