Legal Question in Real Estate Law in Texas

break a lease if furloughed after 9/11 incident

i was furloughed (american airlines flight attendant) as of nov 1, 2001. i live in pasadena, texas but was based in dfw, texas like many others i rented an apartment to use when in town. when paying my nov rent i told the apt mgr i needed out of my apt and would try to find soemone to rent it or a roommate i could stay but with so many furloughs impossible.I did not wish to ruin my credit. no reply i contacted the corporate office this month she said they would let me out of my lease. no details just call the apt dec 3. i did . she said their policy on the furloughed employees was 1mo rent w/ move out notice and 1 mo relett fee. i was not told this last month when i expressed the need to change this agreement and paid nov's rent. she says i must pay this mo+relett fee. anyway to get them to count last mo as rent and this mo for the relett fee? unemployment us not enough to pay again. i would not need to with a little information last moa as savings would have covered it. i need my credit and rent ability i was going to sign a 6 month lease nov would have been 6 months but i was talked into a year to hold the price. i had no way of knowing 9/11 would happen.

The lease is a contract. Review the lease to determine is there is a provision that lets's you out if you relocate or lose your job. Otherwise, the deal that the Landlord is offering you is not bad. You might argue that the one month notice was given last month. Unfortunately it sounds like you gave less than one month. you paid rent after the 1st of month, and the Landlord is holding you to one months notice. Look at the lease carefully to determine your rights. Larry Maun 713.266.2560
