Legal Question in Real Estate Law in Texas

Can I break a lease?

I have received letters from my landlords owner's association that I am in violation of the ''pets section'' of the associations rules. I had approval from my landlord for these pets. The owners association seems very upset, and I want to move. If I am evicted, am I laible for future rent and does this effect my credit? Can I legally keep them from effect my credit rating?

Re: Can I break a lease?

I am auuming you are leasing a condo subject to a homeowners association. Your landlord, who I assume is the owner of the unit you lease, is subject to the rules and regulations of the home owners association. It soulnds like he did not know, or misrepresented to you what the "pet" rules are. Get a copy of the rules to determine if you are actually violating them. If you are you probably have cause to avoid your lease as it was entered into by you without knowledge of the restrictions, which the landlord should know. The landlord should also be notified that he should not report your voiding the lease to any credit reporting agency. Do everything in writing. Larry Maun 713.266.2560
