Legal Question in Real Estate Law in Texas

I was a buyer for a home and after signing the contract and giving $1000 in earnest money, the builder required an additional $25,000 in down payment which I paid--we made an addendum to the original contract. After that our financing fell through. I signed a release to get the $1000 earnest money back. All parties signed the release and they mailed the check but I haven't deposited. Now the builder refused to give back the $25K bc he says I released him. Is he right? It seems like that $25K is different that the earnest money and I did not release for that.

I would really need to review those papers before answering. You get all sorts of provisions thrown into contracts. More importantly if they were using a realtor, the realtor should be using only Texas Association of Realtor forms. Let me know if you would like me to review them. - NC
