Legal Question in Real Estate Law in Texas

Condo Right of First Refusal More

What would you need to see in the Declarations? I guess I'm missing the point somehow. Our Declarations state that the association means the unit owners which shall be members. I realize the Association is it's own entity of which I am a member. The Declarations state that sale of a unit shall be given to the BOD for all of the owners. The owners thru the BOD shall have the right to purchase. But, how am I ever afforded the right to purchase a unit at the selling price if I am never made aware of the units for sale or the price at which they are being sold?

You're missing the portion on Board action. It is the Board of Directors who act on behalf of ALL of the owners. However, their actions are for the benefit of the owners as a whole, not as individuals.
