Legal Question in Real Estate Law in Texas

Are we entitled to oil/gas benefits?

My father, passed 2001, have 8 living siblings and they are receiving benefits

from oil/gas companies of 20 acres of their deceased parents property and family home. All siblings including my father's name are listed on the deed (1954) and their mother's last will(1985). I want to know if myself and my siblings (heirship) have a right to receive benefits(funds) also from the gas companies? Because we are not and my uncle who is also POA said they are using the funds to upkeep the family house and pay taxes, but I want to know if we have a say how the money should be used and/or disbursed?

This is a two part question. If your father died in 2001, you may still have time to probate his estate. This would force a distribution. But you only have four years after the date of death to do so. I would strongly suggest you call an attorney.
