Legal Question in Real Estate Law in Texas

Forclosure and leasing.

We are leasing a property and just

found out that the owner has not been

paying the mortgage. The mortgage

company sent a notice to our

residence stating that they will be

taking possesion of the house in the

next 60 to 90 days. At this point, are

we still bound by our lease or can we

consider it void?

The foreclosure will void your lease if the deed of trust was executed before you leased the property.
