Legal Question in Real Estate Law in Texas

Renig on Purchase Contract

I have a contract to sell my home. The closing was scheduled for today and the buyer called his real estate agent 2 hours after the closing and told her he didn't want to purchase the property due to a hurricane approaching the area. Can he do this?

Re: Renig on Purchase Contract

If the closing occurred -- both sides signed documents and the title company received them -- your buyer owns the house. If not, then your rights on the buyer's failure to close are spelled out in the contract. You may only be entitled to recover the earnest money, or you may have the right to force a closing, depending on what the contract says.
