Legal Question in Real Estate Law in Texas

Hello,

Approximately 3 years ago, a friend of mine lost his job and was unable to collect unemployment, so I offered to let him stay with me for a while. No contract was signed. In 2009, I was a one time payment of $200, and in 2010, I was given $500. So in three years, he has paid $700. As of today he is still unemployed, with no means of income of any type.

I now have a fiancée and her 14 year old son living in the house also.

This morning at 6:30am I walked out of the bedroom, and the “friend” physically assaulted me, unprovoked, hitting me about the head and chest area. The police were called and he was arrested and taken to jail.

Now I fear for the safety of my fiancée, her son, myself and what may happen to my house. What legal right do I have to keep him out of my home? The police said I would have to file a 30 day eviction notice, and during this time I could not keep him out of the house. I do not want him around my fiancée and her son… do I have options?

Go to your local JP and get a Protective Order. Then file the eviction.
