Legal Question in Real Estate Law in Texas

Townhome Association rules

A family member owns a townhome paid for in full, but I have been paying for the Association fees and insurance monthly fees, plus School and City taxes on the property for about 7 years. My name is no on anything except I have paid all the bills. The person is not able to live there anymore.

It has about 1500 sqfeet and is just full of about 10,000 books, magazines, furniture, etc ( a pack rat)

If I stop paying the dues, who would be responsible for the clean up of these items. Many could sell for a good price, auto books, etc.

Would townhome association clean it out, sell what they could and call it even, or would someone have to pay for this. The person can not pay, and I do not think I am legally bound to anything.

Thanks

Lauren

Re: Townhome Association rules

You shouldn't be liable for anything, but you should encourage the family member to sell the condo, otherwise, it will go to foreclosure and someone will reap the benefit of a distressed sale. When I buy a property when someone has been a packrat, I hire a "guy" to clean up and haul off trash. The cost is about $500. Please note that if it is foreclosed, then family member would be entitled to excess proceeds, if any.
