Legal Question in Real Estate Law in Texas

Water Damage

I had a flood in my bathroom which caused damage to the apartment below me. I do not use that bathroom and did not have any company that used it prior to the flood. My apartment manager has indicated that they will be billing me for the damages. I do not believe that I should be liable since I do not own nor am responsible for maintainance for the bathroom fixtures. Am I liable?

Re: Water Damage

The answer depends on two things: what your lease says you're liable for, and whether or not you caused the flooding in some form or fashion. If you didn't cause it, nor assumed liability via your contract (i.e., your lease) then you are not liable. That doesn't mean though, that they won't try to extract it out of you either now or later when you move out; so get ready for a fight.
