Legal Question in Sexual Harassment in Texas

Homophobic or sexual harrasment?

I was the (female) GM for a large restaurant chain. In the beginning of August a new training GM came into the store. We allowed her to do some hiring, she hired a female friend who continually made passes at me. I reported it to the Director of Ops, was told he would take care of it. They laid her off for a week, at the end of that week the DO met with me told me I was terminated. I found out the next day-she returned to work the day I was terminated. I have an exemplary record-no counseling or write-ups and have witnesses to the harrasment and instances of other harrasment to other employees. The DO, franchiser and even the corporation have had several complaints of sexual harrasment-what recourse do I have if any? What applies here, sexual harrasment, retaliation, unlawful termination, hostile work environment, or unlawful retention? Who do I need to follow up with? How do I find legal representation if needed?

Re: Homophobic or sexual harrasment?

You have what sounds like a very good case. You need to consult with an attorney and then contact the EEOC or TCHR in your area. This sounds like a straight retaliation case. You need to follow the handbook that you were given when employed as to any appeal rights you may have. Finally, you should keep a diary of what you are feeling like now and if honestly needed, get counselling.
