Legal Question in Traffic Law in Texas

automobile damage

My car was parked on the street in front of my home when a neighbor's child ran into it with her bicycle and left a dent. My insurance company is saying i can only file it on my policy and they can't go after my neighbor for reimbursement of my deductible later because it wasn't an auto that hit my car nor was it him(the neighbor) directly. He initially agreed to pay for the damages. I then had an estimate done and gave it to him, but to date, he has not paid. Since the car was sitting on the street and his child hit it, Can I push his liability? or Did the location of my car negate his liability?

You can sue him for the damages in court and obtain a judgment against him for the damages his child caused.
