Legal Question in Traffic Law in Texas

during a traffic stop which was conducted in our driveway next to our home. the officer stated that while running her license he stated that showed her having a concealed hand gun license which she does not have or ever had. He kept telling her that he knows for a fact that there is a gun in her car and started to search the car without her consent right there in our driveway. due to loss of income the insurance had not been paid. the car was impounded from our driveway, can this be done on a first offense. The laws states first offense the penalty will be only a fine. if there are constant offenses the fine will increase and the possibility of suspension of your drivers license and possible impoundment of your vehicle THIS IS THE first time she was stopped and found that there was no insurance. can they legally take the vehicle and not follow the state law penalty?

How did a traffic stop occur in your driveway in front of your home? If the initial stop was illegal, then everything that happened afterward is suppressed, and thus charges dismissed.
