If Dad leaves a will, that document takes precedence in the distribution of property. If there is no will or the will does not address the distribution of property. Texas Law of intestacy governs. There are several variables. Will dad be married when he dies? Will he have adopted the 2 daughters? If dad is married, is the property community or separate? Is the property real estate or personal property. Is the property part of his estate or is it a contract with designated beneficiaries like a life insurance policy, annuity, or POD bank account?

Best to consult dad to see if there is a will and a lawyer if there is not one.
