Legal Question in Wills and Trusts in Texas

Deceased Bill Payment

My father passed away. He had a Visa bill that was outstanding. He did not have any type insurance nor did he leave any assets. Does my Mom have to pay that bill. The bill was in Dad's name only. The credit company is asking for my dads estate and since he did not have anything is there any obligation. How do we handle there request.

Thanks,

Re: Deceased Bill Payment

If your mom wasn't listed as a guarantor on the account and she didn't use the card, then I don't think there is a way to force her to pay for it. You should read the agreement to be sure. As for the request, you can tell the creditors that the person is deceased and no personal rep has been appointed. As a creditor, they can set up an administration if they really want to.
