Legal Question in Wills and Trusts in Texas

deed never transfered from orginal owner/mother left no will

Mother died with no will.All records,i.e. tax, appraisal,still show original owner's name. Can I still file heirship papers? I have copies of payment books from the mortgage company,so she was not renting or leasing. my dad is still living

Were your parents still married at the time of her death? If not, did she have a new husband? Did your mother have children outside the marriage to your father? Who is in the house now?
