Legal Question in Wills and Trusts in Texas

Hi my father just passed on 07/20/09 at work we are still waiting on the autopsy which the Justice of Peace stated that it will take 3 to 4 weeks. Okay my question is that my father didn't have a will and he just married 9 months ago my father bought his home and vehicles before their marriage I want to know legal part of this. He has two children my older sister and I. I don't want her to sell anything of his or give his property to some of her family so my question is what are his kids legal rights in this matter?

Sorry for your loss. In all probability, given the shortness of his new marriage, most of his property is probably separate property and should go to you and your sister. You should contact a local probate attorney as soon as possible.
