Legal Question in Wills and Trusts in Texas

Father's Died and Step Wife won't share will

My father died April 18th of 2009 and

my step-mother says that he left

everything to her, but we haven't

seen a will yet. He has a 401K and

land with a house that's paid for.

What rights do we have as his grown

children?

If there is a will you can petition the probate court to force her to produce the will. IF there is no will, then the default intestacy rules apply. You need a lawyer, fast.
