Legal Question in Wills and Trusts in Texas

My grandmother left her house to my mother in a handwritten will. My mother lived in that house for 30 years after grandmothers death and paid the taxes but never had the house changed to her name. My mothe died a few weeks ago. What can I do about the house?

Call a probate attorney in the county where your mother resided.. because IF there were other heirs than your mother to grandmother, the will is of no importance as wills have to be probated within 4 years, but the lawyer may have other solutions when he gets all the facts.

Mom should have probated Grandma's will. You'll need to check the probate records and see if she filed anything. If not, you have an issue, which will be fact specific. In order to tell you to do, I would need the following information:

1. Whose name is on title? Grandma? Mom? Grandpa?

2. Are there any liens? Mortgages? Taxes?

3. How many children did Grandma have, total? Are they all around?

4. What do you want to do with the house? Are all family members in agreement?

5. Did mom have any other debts or assets?
