Legal Question in Wills and Trusts in Texas

Heirship

My mother died in 1986 and at the time of her death was

stilled married to my father. She left had no will.

My father wishes to sell the land that the two of them

purchased while she was alive, our childhood home.

I have only one other sibling and I want to know if we are entitled to any of the money made off the sale

of the property?

Re: Heirship

Your father will have to have her estate probated to determine heirship. Then all will have to agree whether the property was community property.

If the real property was community property, you and your siblings would be entitled to half the net value.
