Legal Question in Wills and Trusts in Texas

My husband passed away last month without a will. We have been separated for 5 years so we are legally married still - he lived in Texas and I in Pennsylvania. The only thing in both our names are the house and his truck. Am I responsible for his bills and do I have to file probate?

If there is no will you need to do something regarding his estate to establish the change in title of the house. You are only responsible for bills for necessaries , food, clothing, shelter and for items you agreed to pay, such as a mortgage on the house, or a joint credit card.

correct..agree with Keith...and urge u to contact a lawyer in the county where he resided..it may not be economical to do anything but if he has bills, the creditors may probate, sell the house and use that to be paid...yu personally are not responsible...but his estate is..
