What is the Liability for a Power of Attorney
My husband was chosen to be Power of Attorney over his mom who lived with us 7 1/2 years. Upon her death his brother wants a listing of every cent spent during the past 7 1/2 years. Does he have to give his records over? Or should he wait for his lawyer to request the records? Does he have to give account for every cent spent?
Re: What is the Liability for a Power of Attorney
The holder of the Power of Attorney has a fiduciary duty to the grantor of those powers, and may have to account for expenditures to the grantor or someone with legal standing to represent the grantor. I do not see where the brother has standing to assert his demand.
