Minimum amount to go to Probate

Almost all of my parents assets were in the name of their living trust when my father passed away - all except for $3k in stocks in his name and the title to their 10-year old car ($4-5k max).

Do I still have to go to probate or are these values small enough that it doesn't warrant taking up the court's time?

You still have to go to court. The Texas Department of Public Safety has an heirship affidavit on line that you can download and fill out. As to the stocks the Broker/dealer is going to want a court order to transfer the stock. Consider a small estate affidavit and order, if the estate fits the picture.
