Legal Question in Wills and Trusts in Texas

Is money from a Accidental Death Policy part of the estate?

My mother took out an Accidental Death Policy many years ago on my step-dad. Two years ago he was killed in an automobile accident. He had 4 children and mom has 5. When she got the money she put it in CD's under her name. The will was probated last week, which states upon her death all assets will be divided equally. My question is, is this money she received from the Accident Death Policy included as all assets? At this point we are filling out what all assets he, my step-dad and mom had at the time of his death. Mom did not receive this money until 5 months after his death, so is this part of his assets also?

Thank you

It depends on who is the beneficary of the policy. If its your mom then she gets the money, if its the estate, then the estate gets the money
