Legal Question in Wills and Trusts in Texas

Payee on death

My husband made his checking account, savings account payable on death to his daughter. While a large amount of this money was his before the marriage, he has continued to add savings to it, he deposits his social security check there. The POD assignment was made about five years after our marriage, so some of the funds are community property. He did not get my permission to do so. Do I have any right to a portion of these funds after his death?

Re: Payee on death

You probably have a right to some of the money, since your husband can't give away your portion of the community estate. However it will require a lawsuit if the daughter won't negotiate a reasonable settlement.
