Re: power of attorney

In short, you cannot get a power of attorney for a deceased person in Texas. Under Texas law, a power of attorney authority dies with the person. If you are trying to gain access to your father's accounts, or real property, then you will need to do a probate procedure. The appropriate procedure depends on the estate's size, objectives of the family, and whether or not your father had a will. Please feel free to contact me directly if you wish to discuss your options in greater detail.
