Legal Question in Wills and Trusts in Texas

Getting rid of an unwanted squatter

I would like to know what options I have of getting one of my sons off of my property after my husband dies. My son wants to dig a well and put a trailer house on our property. The land and house become mine in the case of my husband's death. I don't want him on this land after my husband passes. What legal action can I take to make him leave?

Re: Getting rid of an unwanted squatter

I assume that the property is community property, bought while you and your husband were married. If that's the case, and your son is your child, your husband is going to have to agree with you that the squatter is going to have to go. He should have a will leaving all his property to you, and vice versa.

Then when the property is all yours you can order him off the property unless your husband has given part of the property to him by a properly executed deed.
