Legal Question in Wills and Trusts in Texas

Searching Bank records

I would like to know what steps I need to take to have my fathers bank records released to me for the last 5 to 10 years. He passed away recently and my sister says he was broke and I don't believe that, she is the executor of the will.

Re: Searching Bank records

If the will has been filed for probate, then you can check the accounting that goes along with it. That would tell you whether there was money in the estate or not. If the will has not been filed, then you can petition the court to have the custodian of the will present the will to the court and file it for probate yourself, with grounds that the named executor is failing to act.
