If my husband passes away and we do not reside togather who is over the estate with no will in place

Depends upon whether there are children of the marriage, or a prior marriage, or whether there are no children at all. If the children are of this marriage, or there are no children, the spouse gets all. If there are children of a prior marriage, then the spouse shares with the children.
