Legal Question in Wills and Trusts in Texas

My Aunt died leaving a will. Her will didn't mention a CD with a quite large amount. It was left to her brother and sister who both died after she did. Her brother's daughter went to the Safty Deposit Box and tryed to scratch out my mother's name. I don't know that she had any wintness from to the bank to OK this? Is there anything I can do about this?

It all depends upon the language of the will, and the nature of the CD. If the CD was joint with right of survivorship, then it passed when your aunt died. If the CD was payable to your aunt, and her will left "all my property", then the CD would be counted in with "property".
