Legal Question in Wills and Trusts in Texas

Uncle dies without will several years ago.His sister has been paying for upkeep and taxes on land since. She now needs to sell. She has obtained release of interest from 43 of 44 relatives.Uncles one neice refuses. Can we proceed without her consent?

Possibly. If the title work was done properly, then the sister can file for a partition to force the sale of the property. There may be other mechanisms as well, but that one seems to be the best fit.
