Wills and Executorship

My mom died in Sept 2008 and my step dad received her will declaring my brother-in law her Executor and asked for his estate to be divided among her children, including his pension, autos and property sales

I don't see a question here, but the will needs to be probated. The executor needs to contact an attorney.

I agree there is no question here, but I'm confused about what it is your mother left to others in her Will. She can't give away your stepfather's property while he is still alive.
