Legal Question in Wills and Trusts in Texas

My brother took my mothers original will to a lawyer for questions. The lawyer kept the will in his office awaiting payment for a retainer fee.

I want to file the will myself. Does the lawyer have to give me the will if I ask for it?

Yes. It does not "belong" to the lawyer, although if and when he represents the estate he can "borrow" it. I would ask for the original back; if he wants to make a copy for his records, I would let him. You can file it by yourself or with the assistance of any probate lawyer.
