I was wondering if the house is under his name would it go to the next of kin?
My father dies 2 years ago. and my cousin is living in his house while i strugle to pay rent. My dad didn't leave a will. I wanted to know if the house would go to the next of kin since he didn't leave a will.

The house would go to his children, if he didn't leave a wife. You'll have to prove up the fact that you are entitled to the property through a judicial process called determination of heirship.
