Legal Question in Workers Comp in Texas

5 years since last sought medical treatment, now having trouble, insurance does

I was injured in Texas in 1992 and went through the whole gamut of problems with carriers. My leg was injured but the irregular gait pattern induced by the injury caused me to have lumbar problems. The carrier fought it but a decision was renedred where the lower spine was included. I am back to work in a more sedentary profession and have not had any back problems since 1997. However, the doctor at that time told me in the future I may have some. I am now having problems and the carrier is blocking my attempts to get remedy. They have denied an MRI requested by the doctor and are questioning why I have not sought treatment in over 5 years. What can I do?

Your doctor will need to justify the need for treatment to the Insurance Carrier, and if need be, to appeal the decision to the medical appeals board in Austin.
