Legal Question in Workers Comp in Texas

My husband sustained a traumatic braininjury on 8/27/09. As of this writing he has still not received a MMI/IR from a doctor. The insurance carrier gave him a general assessment rating. What do we do?

The lawyer we hired to assist has done absolutely nothing and is reluctant to return phone calls.
