Legal Question in Workers Comp in Texas

Shoulder Injury

Im a 60 yr old delivery driver for a major shipping company, and on april 4th I injured my right shoulder on the job. Not knowing what the laws were, I took my managers advice and went to the company dr. He took an xray and put me on light duty, in which there is no light duty. Being in pain, I went to another dr. and it turned out i had a tear and needed surgery. I have been off work for 8 wks now, and am now receiving wk pay. the first 4 weeks, i recieved nothing due to mis diagnosis by co. dr. WK is paying for medical. My question is, is there anything that can be done for loss of pay because of mis diagnosis. My currnet Dr.s are telling me that I may never be able to do the work Im used to again.

I am currently in Therapy.

Our firm handles Texas work comp and nonsubscriber cases..but without more facts, we could not tell you what you should receive..many companies do not have Texas work comp insurance but some private plans..and if the employer is negligent, you could have a substantial claim...we would be happy to talk to you..
