Legal Question in Family Law in Turkey

Child Custody/ Guardianship

I am a Canadian citizen married to a Turkish man. living together in Canada. We have an 11 year old cousin in Istanbul whom we wish to bring to Canada to live with us. Family is supportive of the idea. How do we go about obtaining custody/guardianship of the child?

Re: Child Custody/ Guardianship

First you must bring a suit in Istanbul for this. But there is a lot of requirements that the court will ask for. These are .

1. You must look after your cousin for 1 year before suit.(You must invite him to Canada for 1 year or if you or your husband will be in Turkey for 1 year even in interchange it will be ok.)

2. Both partners will agree at court for this.

3. You must be married for 5 years or you must both over 30 years old.

4. You must both older than your cousin at least 18 years.

5. If he/she 11 years old, must come to court and agree for this.

6. His/Her parents come to court and agree for this.

(If the other requirements are ok, the first one can be arranged.)

Please do not hesitate for any other questions.
