Legal Question in Real Estate Law in Turkey

Letting out joint-owned property

I am a UK citizen living in Turkey. My brother and I are joint owners of an apartment in the Republic of Cyprus. We own a quarter share each. My stepmother, also a UK citizen, owns the other half share. I have recently discovered that my stepmother is letting out the property and taking all the rent money. I have not yet confronted her on this issue, but the tenants are now aware of the situation. Before I take this matter further, I would like to know what to do. Thank you in advance for your attention.

Re: Letting out joint-owned property

Dear Sirs,

Thank you for your question.

Taking into consideration that your apartment is situated in the Republic of Cyprus. Your case is be subject to local law.

If this case would be subject to Turkish law, you would need to send the legal notice through the notary public in order to claim a quarter of rental fee. In case your stepmother would refuse to pay, you would be entitled to initiate a lawsuit against her.

If you have any additional question please do not hesitate to contact us.

Your faithfully,
