Wating for H1 and on L1

Hi,

I have L1b, so if I resign from the current company, will my L1 be void.

I have offer from other company. Is there anyway to stay till I have my H1b approved ?

If you resign from your current L-1 position, you will no longer be in lawful L-1 status. Moreover, they have already reached the H-1B cap, so you will not be able to start your H-1B job until October 1, 2005. One possibility is to apply for a change of status to B-1 to remain until October 1, 2005, but there a number of issues to take into consideration before you take this step. If your H1B was already filed and accepted by CIS, then you can stay until your H1B approval. If the H1B is not yet filed, then your options are very limited and need further evaluation.
