husband walked out of jointly owned property 28th Dec 06. we have 2 small boys aged 1 and 3. My father and I owned property first and husband paid �6,000 to take over my fathers part on the mortgage. What rights do I have with regard to staying in the property with the boys and is there any law that states he has to have his �6,000 back. He is desperate to get his name off mortgage and has asked for �6,000.

the legal position relevant to the jointly owned property is going to depend upon whether or not your marriage is to be dissolved. The first question for you therefore is whether or not this is a divorce situation. If it is and you intend to file a divorce petition then rights of ownership and occupation of the property must be decided in the divorce settlement.There is much further information on our website which will hopefully assist.
