last name change to maiden name

my childs last name has his fathers last

name. i would like to change it my last

name. we are not married. what is the

process. Do i need authorization from

the father?

If you have sole physical and legal custody of the child, then you do not need the father's permission.

If you do not have sole physical and legal custody you would need the biological father's consent. You would file a petition for name change in the Probate and Family Court and give notice to all interested parties as the court directs. If you anticipate opposition from the biological father you may want to consider retaining an attorney to assist you. Good Luck!
