Are you sure you meant to post this as a Virgin Islands legal question? The name you use for the motion is not one that is commonly used in the VI.

As a general rule, however, yes, you normally should get an answer one way or the other. In the VI, I (as the lawyer) would call the judge's law clerk to make sure that it hasn't fallen through the cracks. If it really is an emergency and the judge isn't ruling, then the next step is to seek mandamus (an order directing the jude to act) from the court of appeals.
