Legal Question in Personal Injury in United States Virgin Islands

Car accident (scar)

I was hit head on while working in St Croix, USVI. I received a burn when the airbag deployed and I am left with a permanant scar on my left forearm. The other driver was in my lane and receiveds two citations. Am I entitled to any compensation?

Re: Car accident (scar)

As you describe the circumstances, I think you are entitled to compensation. It sounds like the other driver was negligent and you suffered injury as a result. That's generally compensable. We do not have no-fault here, so you would need to collect from the other driver (and hopefully his insurer, if he had insurance).

Keep in mind that all claims are subject to time limits that can prohibit your claim if you do not pursue it in a timely fashion and in the appropriate forum. (I don't give information on time limits over the Internet because those limits may vary depending upon your facts. For example, if the other driver was an employee of the local government, there may be a different time limit and different procedure to follow than if he was a private citizen.) The solution is to act without delay.

Hope this helps,

Andy Simpson
