warranty deed

the clause, '' to have and to hold the premises hereby granted unto the Grantee ( my ex-husband and myself) their successors and assigns, in fee simple forever.'' Does this limit who may inherit his half of the home to our children that we share or can children from previous relationships lay claim to his half of the home that was built while we were married.

Who inherits the house will depend on how the property is owned and the terms of any will. The language you quoted does not determine how the property will pass.

Children from previous relationships may have a right to a portion of the inheritance if proper estate planning is not in place.
